Terms of Service

Agreement

These terms are an agreement between you and ZeyMail Inc. (“ZeyMail”, “we”, “us”) for the use of ZeyMail, including the website at www.zeymail.com, the application at app.zeymail.com and @zeymail.com email addresses (together, the “service”). By signing in or using the service, you accept these terms, our Privacy Policy and our Acceptable Use Policy. If you do not accept them, do not use the service.

The service

ZeyMail provides email mailboxes on the zeymail.com domain, accessed through a web browser. Features may include receiving, reading, organising, searching and sending email. Some features, such as sending email, may not be enabled for every mailbox.

Accounts and eligibility

• There is no public sign-up. Accounts are created by an administrator for a named person or organisation.
• You must be at least 18 years old, or use the service under the authority of an organisation that is responsible for you.
• Give accurate information, and use only the account that was issued to you.
• Each address belongs to the ZeyMail domain. It is not transferable and remains available to you only while your account is active.

Administrators

If you administer mailboxes for others, you are responsible for how those mailboxes are used. You confirm that you have the authority and, where required, the consent of each person to create and manage a mailbox for them, that you will use administrator access only for legitimate purposes, and that you will make sure the people you issue mailboxes to follow these terms.

Keeping your account secure

• Keep your password secret and change the temporary password you receive on first sign-in.
• You are responsible for activity on your account unless it resulted from our own failure.
• Tell your administrator, or us at [email protected], as soon as you suspect someone else has used your account.

Acceptable use

You must follow our Acceptable Use Policy. In short: no spam, phishing, malware, fraud, impersonation, harassment or illegal content, and no use that harms the service or other people.

Your content

You keep all rights in the messages and files you store or send. You give us permission to store, process, transmit and display that content only as needed to provide, secure and support the service. You are responsible for your content and for having the right to send it.

Availability and changes

We work to keep the service available and secure, but we do not guarantee that it will be uninterrupted or error-free, or that every message will be delivered. Email can be delayed, filtered or rejected by other providers outside our control. We may change, add or remove features. Keep your own copy of anything you cannot afford to lose.

Suspension and termination

• We may suspend or deactivate an account, block messages, or remove content, without notice, if we reasonably believe it breaches these terms or the Acceptable Use Policy, puts the service or others at risk, or if the law requires it.
• Your administrator may deactivate your account at any time.
• When an account is deactivated, sign-in stops. Stored mail may be kept or deleted as described in our Privacy Policy. A deactivated address is not reissued to someone else.

Fees

Any fees for the service are agreed separately between ZeyMail Inc. and the organisation that holds the mailboxes. Individual users are not charged.

No warranty

To the extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose. See also our Disclaimer.

Limitation of liability

To the extent the law allows, ZeyMail Inc. is not liable for any indirect, incidental, special or consequential loss, or for loss of data, profits, business or opportunity, arising from use of or inability to use the service, including missed, delayed or misdirected email. Our total liability for any claim is limited to the fees paid for the affected mailbox in the three months before the claim. Nothing in these terms limits liability that cannot be limited by law.

Indemnity

You agree to compensate ZeyMail Inc. for claims, losses and costs arising from your breach of these terms or your misuse of the service.

Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute. If any part of these terms is found unenforceable, the rest remains in effect.

Changes to these terms

We may update these terms. We will revise the date at the top of this page and, for material changes, tell administrators before the change takes effect. Continuing to use the service after that means you accept the updated terms.
